If the mobile phone or other computer device is stolen under threat or violence, it is robbery. The Court of Cassation established it in sentence no. 2429 of 10 June 2016, with which the sentence was confirmed a\u00a0<strong>1 year and 8 months<\/strong>\u00a0of imprisonment to a man who had spied on his wife&#039;s conversations after violently stealing his cell phone.\r\n<h3 class=\"spip\">Spying on partner&#039;s emails and sms: it is forbidden even if it serves to exercise the defense in court<\/h3>\r\nNot even the need to exercise the\u00a0<strong>right of defense<\/strong> in court. Therefore, gathering evidence justifies the conduct of spying on other people&#039;s conversations, even though, in isolated cases, there have been rulings to the contrary. Therefore, it is not permissible to spy on a partner&#039;s text messages or emails to prove infidelity (for example, for separation purposes). Or an employee&#039;s infidelity (for dismissal for just cause).
