SendApp - Terms and Conditions of Use
The following general terms and conditions (hereinafter "Terms and Conditions") govern the use of this website and the content made available through the websites (hereinafter "Sites") sendapp.live, sendapp.cloud, including but not limited to:
Name of sites: sendapp.live, sendapp.cloud
The Sites are owned and operated by SendApp, a product of SendApp Inc. (hereinafter "SendApp", "we", "us" or "our"). Access to and use of the Sites implies full acceptance of these Terms and Conditions.
1. Registration
It is not necessary to register with the Sites to access content or services; however, some areas and features may be restricted to registered users. In that case, the user must agree to a separate Subscription Agreement.
2. Property rights
Use of the Sites does not grant any intellectual property rights to the content, code, data, or materials accessed. Only one copy of the content may be downloaded for personal, non-commercial use only. Any unauthorized use may constitute a violation of Italian or international laws.
3. Copyright agent
In case of suspected copyright infringement, the user can contact SendApp by providing detailed information according to the regulations.
4. Trademarks
Trademarks on the Sites are registered by SendApp or third parties. No part of the Sites may be construed as granting a license to use such trademarks.
5. Changes to the Terms and Conditions
SendApp reserves the right to change the Terms and Conditions at any time. Changes will become effective upon their posting on the Sites.
6. User information
You are responsible for the accuracy of the personal information you provide. Our privacy policy can be found in the appropriate section.
7. Links to Sites
You are permitted to link to the Sites only to full HTML pages. SendApp reserves the right to revoke this permission at any time.
8. Third-party sites
SendApp is not responsible for content, services, or materials on linked sites. The inclusion of links does not imply endorsement by SendApp.
9. Reimbursement exclusion clause
All software products sold through the Sites are considered to be digital assets activated and immediately usable. According to current legislation (Directive 2011/83/EU), there is no right of withdrawal or refund for activated digital products.
You irrevocably agree that your purchase waives all rights to a refund unless expressly waived in writing by SendApp on an exceptional basis.
10. Disclaimer clause
SendApp assumes no responsibility for user's improper, unlawful, or noncompliant use of the software. The user is required to use the tool in full compliance with regulations, including platform policies (e.g., WhatsApp) and GDPR.
Improper use of the tool, such as sending spam or uploading unprofiled address books, may result in suspension of the number or termination of service by third parties. SendApp disclaims any liability for direct or indirect damages, lockouts, suspensions, or losses caused by such misuse.
11. Exclusion of guarantees
Within the limits of the law:
- Content and services are provided "as is."
- SendApp does not guarantee uninterrupted or error-free availability of the Sites.
- SendApp will not be liable for indirect damages, loss of data or profits arising from the use of the Sites.
12. License
The license is for life, but can only be used on one device at a time. In case of failure, you can request a reset by sending an e-mail to info@sendapp.live.
13. Applicable legislation
These Terms and Conditions are governed by Italian law. Access to the Sites from other jurisdictions is the responsibility of the user.
14. Anti-spam policy
Use of the software for sending spam is prohibited. Violations will result in suspension or termination of service, as well as possible legal action.
15. Personal data
By agreeing to these terms, you authorize the use of your information for advertising purposes. You may request their deletion at any time.
Note: SendApp is not affiliated with WhatsApp (WhatsApp Inc. and/or WhatsApp Ireland Limited) or any other Meta company. Any changes by these platforms may affect or prevent the operation of the software. The data remains stored locally on the user's device.
